1.1. What these terms cover: These are the terms and conditions ("Terms") governing how we purchase items from you and provide services to you through We Buy Any Media.

1.2. Why you should read them: Please review these Terms carefully before submitting offers or orders. They explain who we are, how we buy items, how services are provided, how contracts can be changed or ended, problem resolution, and other key details. If you find any errors or need clarification, please contact us.

2. Glossary of Terms

2.1. In these Terms:

  • "Authorised Seller" means a business, organisation, co-operative, or trader with our written permission to sell Items.
  • "Contract" is the agreement between you and us, based on these Terms, for the sale, recycling, delivery, or return of your Item.
  • "Delivery Services" are the Drop Off or Collection Services for your Item(s) as detailed in clause 12.
  • "Item" means any item you offer to sell us (e.g., Books, CDs, DVDs, Blu-Rays, Games, Tech, Media) as listed on our Website.
  • "Item Condition Guidelines" are our standards for acceptable Item condition during the Quality Assessment.
  • "Item Price" is the price offered on our Website for your Items, subject to Quality Assessment.
  • "Minimum Offer Total" is the minimum value required for us to accept your Offer, found on our Website.
  • "Offer" is your proposal to sell Items to us at the Item Price.
  • "Offer Confirmation" is the email confirming our acceptance of your Offer.
  • "Package" is the box or parcel containing the Item(s) you send.
  • "Quality Assessment" is our process for checking if Item(s) meet our Item Condition Guidelines.
  • "Us / We / Our" refers to We Buy Any Media.
  • "Website" means the We Buy Any Media website and related web services.
  • "Working Day" is a day other than Saturday, Sunday, or a public holiday in England.
  • "You / Your" means the individual using the Website to sell or recycle Items under these Terms.

3. About Us

3.1. We are We Buy Any Media, a trading name. Further company details are available upon request.

3.2. For queries, comments, or complaints about these Terms or our Website, please contact us via the contact form on our Website. If we need to contact you, we'll use the phone number, email, or postal address provided in your Offer.

3.3. If you disagree with these Terms, please refrain from using our Website or services.

4. Use of our Website

4.1. The Website is intended for use by individual consumers, not businesses, organisations, co-operatives, or traders unless they are Authorised Sellers. We reserve the right to withhold payment for Offers from non-Authorised Sellers. Suspected non-Authorised Sellers will be notified via email, and their Items held for fourteen (14) days for collection during business hours (details on Website).

4.2. Charities and Libraries: May become Authorised Sellers via a specific account type. Request this in your account settings; verification may be required. Approval is at our discretion.

4.3. Our services are solely for the UK. We do not accept Items from outside the UK.

4.4. By making an Offer, you confirm:

  • You are an individual consumer legally capable of entering binding contracts.
  • You own the Items or have the owner's permission to sell them.
  • You are at least 18, or have parental/guardian consent if under 18.
  • You are based in the UK.
  • You are accessing the Website from the UK.
  • You have read and understood our Item Condition Guidelines.
  • You have read and understood our Packaging Guidelines.

4.5. By creating an Offer, you warrant that the Item(s) have not been illegally copied, counterfeited, or pirated.

4.6. You confirm the Item(s) are genuine and not illegal copies.

4.7. We will validate the authenticity of Items. We reserve the right to take legal action against organised counterfeiting (e.g., multiple fake items sent over time).

4.8. We cannot accept or return items sent in addition to those in your completed Offer. These will be responsibly recycled.

4.9. We reserve the right to reject items failing quality standards or infringing distribution rights.

5. Account Details

5.1. Provide an email address and create a secure password. Do not share it.

5.2. You are responsible for account security. Use the "Lost password" link to reset if forgotten.

5.3. Only one account per person. Multiple accounts may lead to termination, cancellation of Offers, and reasonable administration fees. Abuse or manipulation of the Website may result in recouping losses from payments owed, account termination, and Offer cancellation.

5.4. Notify us immediately if you suspect unauthorised use of your account.

6. Privacy Statement

You acknowledge and agree to be bound by the terms of our Privacy Policy.

7. Selling Your Item(s)

7.1. To sell Items via our Website:

  1. Enter the barcode/ISBN/identifier for the Item(s).
  2. Receive an instant Item Price.
  3. Add Items to your basket. Once satisfied and the Minimum Offer Total is met, click 'Sell My Items'.
  4. Confirm acceptance of these Terms.
  5. Register or sign in.
  6. Select payment method and shipping option.
  7. Click 'Accept Offer'.

8. The Contract

8.1. Clicking ‘Accept Offer’ constitutes your offer to supply Item(s) at the agreed price and use related Delivery Services.

8.2. All Offers require our acceptance. We are not obligated to accept any Offer. Conditional acceptance is confirmed via an Offer Confirmation email.

8.3. Send Item(s) within seven (7) days of the Offer Confirmation (unless otherwise agreed). After this, the Offer may be cancelled, and Items may need re-listing.

8.4. Payment is conditional on Item(s) passing our Quality Assessment.

8.5. If Item(s) pass, we pay the Item Price. If not, we reserve the right to revise the Offer.

9. Offers

9.1. The Item Price offered is valid for twenty-eight (28) days from Offer creation, subject to Quality Assessment.

9.2. Any Item Price or Order Confirmation is our property. Use the valuation service only for Items you own and consider selling.

10. Your Cancellation Rights

10.1. You can cancel your Contract within fourteen (14) days of the Offer Confirmation date without reason.

10.2. This cancellation right ends once we begin Delivery Services (i.e., when you drop off Item(s) or they are collected).

10.3. To cancel, notify us in writing within the 14-day period via our website contact form.

10.4. If you cancel before sending, we remove the Item(s)/Offer from our system. No payment will be due for those Items.

11. Cancellation by Us

11.1. We may cancel or amend the Contract if:

  • Items fail Quality Assessment.
  • We believe you are not the legal owner.
  • You previously sold the same title (limits may apply).
  • Items were listed at an incorrect price due to error.
  • Received Items differ from the Offer.

11.2. We will notify you by email if we cancel.

11.3. If cancellation is due to suspected stolen goods, we will investigate and cooperate with police.

11.4. If cancellation is due to our error, we return Item(s) at our expense.

11.5. If cancellation is due to failed Quality Assessment, you'll be emailed and given 5 working days to:

  • Arrange collection during business hours.
  • Pay for return postage.
  • Agree to disposal.

The Contract will be amended accordingly.

11.6. If we don't hear back within 5 working days regarding failed Items, they will be responsibly recycled without payment.

12. Delivery Services

12.1. Choose how to send Item(s):

  • Drop Off Service: Take Item(s) to a designated carrier point for free shipping to us. Locations on Website.
  • Collection Service: Arrange free carrier collection from home/workplace. Details on Website.
  • Premium Service: Details of any premium options available on Website.

12.2. Items failing Quality Assessment or sent in error can be returned at your expense. A return fee of up to £3.50 may apply, depending on the size and weight of the items being returned. Indicative costs (subject to change):

  • Small items (CD/DVD/Game): Approx. £1.00 - £2.00
  • Standard items (Books/Media under 1KG): Approx. £2.40 - £3.50

12.3. You will be informed of the exact return cost before you confirm the return.

13. Responsibility and Title

13.1. Ownership (title) transfers to us upon receipt at our warehouse.

13.2. Risk (responsibility) transfers:

  • Drop Off Service: When handed over at the drop-off point.
  • Collection Service: When handed over to the carrier representative.

13.3. Damage/loss due to poor packaging not following our Packaging Guidelines remains your responsibility.

13.4. We strongly recommend reading our Packaging Guidelines.

14. Restrictions

14.1. Delivery Services are only for Items being sold to us.

14.2. We and our partners accept no liability for loss/harm from carriage of Restricted Items sent by you.

14.3. You acknowledge our legal obligations regarding carriage, including not transporting "Dangerous Goods" as defined by relevant regulations.

14.4. You are liable for any loss, damage, or liability from breaching these obligations due to your Package contents.

14.5. If you attempt to send restricted items, we and our carriers have no liability whatsoever regarding those items.

15. Problems with Packages

15.1. Obtain and retain a carrier receipt for tracking. Without a valid receipt, we may be unable to claim for loss/damage.

15.2. Ensure correct items are sent. We reserve the right to charge Return Postage Costs and a reasonable administration fee if incorrect items are received.

16. Quality Assessment

16.1. Our decision on items failing Quality Assessment is final. We may provide photos of rejected Items at our discretion. See our Item Condition Guidelines.

17. Liability

17.1. We are responsible for foreseeable loss/damage caused by us breaching these Terms or failing to use reasonable care/skill. Loss/damage is foreseeable if obvious or if discussed during the Offer process. Our liability per Item is limited to its Item Price, and per Contract to the total Item Price(s).

17.2. We do not exclude/limit liability where unlawful (e.g., death/personal injury from negligence, fraud, breach of consumer rights).

17.3. We are not liable for business losses (profit, business interruption, opportunity). Use of our site for commercial purposes is prohibited unless you are an Authorised Seller.

17.4. We are not liable for consequential losses.

17.5. While we strive for accuracy, the Website is provided "as is" without warranties (express or implied) regarding accuracy, non-infringement, compatibility, security, completeness, or fitness for a particular purpose.

17.6. We don't warrant the Website will meet requirements, be uninterrupted, timely, error-free, or free of viruses/bugs. We are not liable for loss of content/material uploaded/transmitted.

17.7. Comply with all applicable regulations/legislation for trading goods with us. We make no representation and accept no liability regarding export/import legality.

17.8. Our Website may link to third-party sites. We are not responsible for their content, accuracy, or opinions. Accessing these sites is at your own risk.

18. Transaction Times

18.1. No guarantee on transaction completion time. We aim for reasonable timescales.

18.2. Guide:

  • Drop Off/Collection Service: Items can take up to five (5) working days to arrive. We are not responsible for carrier delays.
  • Premium Service: Timescales detailed on Website.

19. Payments

19.1. We aim for payment as follows (not guaranteed):

  • Pro-Account Members: Same business day for Offers checked before 3 pm.
  • Non-Pro-Account Members: Following business day for Offers finalised after 1 pm (may take longer at peak times).

19.2. Ensure payment details/addresses are accurate. Loss due to incorrect data provided by you is your responsibility. Recovered funds may incur an administration charge.

19.3. Cheque delivery times vary (e.g., up to 7 working days for second class).

19.4. Email updates provided on Offer status.

19.5. Tax obligations for online sales are your responsibility. Review HMRC guidelines. We respect your privacy and won't contact HMRC about your transactions.

20. Special Offers, Surveys and Competitions

20.1. Refer to specific terms for offers, surveys, and competitions on our Website.

20.2. Competition Rules:

  • We are the promoter. You warrant you have legal capacity to enter.
  • We can cancel/amend Competitions/Rules; our decision is final.
  • Entry requirements specified per Competition.
  • Disqualification for rule breaches or conduct contrary to the Competition spirit.
  • Entry is free (internet charges may apply).
  • Prize details provided before entry; no cash alternative, non-transferable.
  • We are not responsible for damage, loss, injury, or disappointment from entering or prize acceptance/non-acceptance.
  • Governed by English law.

21. Third Party Service Providers

21.1. We use other companies for functions (e.g., reviews, surveys, emails). They access necessary personal info but only for their functions, processing it according to our Privacy Policy and data protection laws.

21.2. You can manage communication preferences in 'My Account'.

22. Changes to Legal Notices

22.1. We reserve the right to change these Terms. Review them each time you make an Offer.

23. Law, Jurisdiction and Language

23.1. Website, content, and contracts are governed by English law. Parties submit to the exclusive jurisdiction of English and Welsh courts. Contracts concluded in English.

24. Invalidity

24.1. Each paragraph operates separately. If any part is unenforceable, the rest remain effective.

24.2. Failure to enforce any right doesn't waive it.

25. Third Party Rights

25.1. These Terms do not confer rights on third parties.

26. Assignment

26.1. We may transfer our rights/obligations to another organisation; this won't affect your rights.

26.2. You may transfer your rights/obligations only with our written agreement.

27. Refer a Friend

27.1. Refer friends (new customers/non-registered users) via the "Refer a Friend" tab in your account.

27.2. Each referred Friend gets a voucher (e.g., £5) via email. Limit referrals per month (e.g., 5).

27.3. You receive a voucher (e.g., £5) via email after your Friend completes an Offer and receives payment.

27.4. Not eligible if setting up multiple accounts. This may lead to account termination per Clause 5.3.

27.5. Your accepted Offer must exceed the voucher value (e.g., £5) to claim the reward.

27.6. If Friend's Items fail Quality Assessment or Offer value drops below minimum, your reward remains on account for future use.

27.7. Refer a Friend reward may not be combinable with other offers.
